TERMS AND CONDITIONS

Preamble
• This document (General Conditions of Sale), defines the conditions applicable to sales concluded between a purchaser of the products that covers the status of consumer (meaning only the physical persons who make the purchase and act for purposes unrelated to the any entrepreneurial or professional activity carried out), hereinafter referred to as “Customer” and another party selling products through its website www.sandalishop.it.
The e-commerce site Sandali Shop is owned by Bottega del Cuoio whose owner is Zizza Rosaria with registered office in Ostuni (BR) at Via Cattedrale, 36 (hereinafter “Sandali Shop”). VAT No. O1894940749.
• Each purchase operation carried out by the Customer on the www.sandalishop.it site is governed by the provisions of articles 50 and following of the Legislative Decree 6 September 2005, n. 206 (Consumer Code), as well as by Legislative Decree 9 April 2003 n. 70 (c.d. Law on Electronic Commerce).
Sandali Shop is a website for selling products for customers with consumer status.
• For the protection of privacy, reference is made to the law of Legislative Decree 196/2003 “Privacy Code”; the Customer for this purpose will have to read the information, consulting the Privacy section on the site and always give prior consent to the processing of data in order to proceed in the order.

1- Acceptance of the General Conditions of Sale

1.1 The contract stipulated between Sandali Shop and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Sandali Shop. This acceptance is considered tacit, if not communicated to the Customer in any way.

1.2 The Customer with the execution of the order declares to have read and accepted all the general conditions of sale and payment reported in this document and also declares to have carefully read and completely the Privacy section, to know its contents well and to have expressed consent to the processing of data. By sending your purchase order, the Customer therefore accepts them unconditionally and undertakes to comply with them in full.

1.3 The Customer undertakes and, once the purchase procedure has been completed, undertakes to print and keep these General Terms and Conditions of Sale, in compliance with articles 52 and 53 of Legislative Decree 6 September 2005, n. 206 (Consumer Code).

2 – Purchase Methods

2.1 The Customer can purchase the products in the electronic catalog of Sandali Shop as described in the relative technical data sheets. It is understood that the images accompanying the information sheet may differ slightly due to the browser and monitor used, however the description of the product characteristics will always prevail.

2.2 On the Sandali Shop website, all prices to the public are inclusive of VAT.

2.3 The correct reception of the order is confirmed by Sandali Shop by means of an e-mail, sent to the e-mail address communicated by the Customer. This confirmation message shows the order number assigned and all the data entered by the Customer, who undertakes to verify its correctness and to promptly communicate any corrections.

2.4 For every order placed on the Sandali Shop website, a receipt will be included in the package together with the products purchased. In order to have an invoice instead of the receipt the Customer will have to require it at the time of the order. No invoice request can be made after the issue has taken place.

2.5 Sandali Shop reserves the right to cancel orders considered to be unreliable. In this circumstance, if the Customer has made the payment and this proves to be already accredited, Sandali Shop will proceed to the immediate reversal of the total amount of the order.


3- Payment Methods

3.1 Sandali Shop accepts the following forms of payment:

3.1.1 For deliveries made in Italy

a) Credit Cards (Visa and Mastercard Circuits) or Postepay through the PayPal secure server

b) Advance bank transfer

c) Cash on delivery (Only for Italian shipping address)

3.1.2 For deliveries made abroad

a) Credit Cards (Visa and Mastercard Circuits) through the PayPal secure server

b) Advance bank transfer

a) Credit Cards or Postepay through PayPal secure server

In the event of purchase of products with Credit Card or Postepay, the Customer will be directed to the PayPal secure site at the end of the order. At this point, the customer can choose between two options, both of which are free:

• use your Credit Card or Postepay, without needing to register with the PayPal circuit, entering your personal data and credit card information.

• use your PayPal account.

The amount relating to the order will be charged to the Customer’s PayPal account at the time the order is acquired. In case of cancellation of the order either by the Customer or in case of non-acceptance by the Sandali Shop, the amount will be refunded to the Customer’s Paypal account. In case of cancellation of the order, the cancellation of the transaction will be requested and in no case will Sandali Shop be held responsible for any damages, direct or indirect, caused by the delay in the failure to release the amount committed by Paypal. For each transaction executed with the Paypal account, the Customer will receive Paypal confirmation emails. Sandali Shop reserves the right to cancel and / or suspend the order if Paypal sends an e-mail message indicating anomalies and / or payment irregularities; in this case, Sandali Shop reserves the right to ask the Customer for supplementary information and / or to send copies of documents proving the ownership of the card used. In the absence of the required documentation, Sandali Shop reserves the right to refuse the order without the Customer’s right to compensation for damages arising for this reason.

b) Advance bank transfer. In the case of payment by bank transfer in advance, the order placed by the customer will be kept pending until the bank actually credits the amount due on the Sandali Shop’s account. This accreditation must take place within 3 working days from the date of acceptance of the order. In any case, the products will be shipped only after Sandali Shop match the credit on their current account. The purpose of the transfer must necessarily include the order number. The bank transfer details will be sent by e-mail when the order is confirmed.

c) Cash on delivery. In case of cash on delivery, payment must be made exclusively with cash. Cash on delivery requires a supplement of € 4.90 for cash collection costs. Also for this specific case, Sandali Shop, will send the shipment to the GLS courier. The courier only accepts exact sums, corresponding to the amount of the order (it is not possible to have change). Nothing more than what indicated at the time of the order will be due by the Customer.

4- Shipping and Delivery

4.1 Sandali Shop sells with its website in Italy (including San Marino), in Europe and throughout the world (with some exceptions). Sandali Shop therefore accepts only orders with delivery in the territories in which it sells and for which, when ordering, you can view the shipping costs.

4.2 The delivery costs for Italy, have a fixed cost of € 2.90 and are considered blocked for shipments that include up to a maximum of 10 pairs of sandals. The payment of the goods by the Customer will take place using the chosen mode act of the order. The courier of reference is GLS with the exception of shipments made in the Islands, Calabria Region and Basilicata where the courier of reference could be TNT. Nothing is more due by the Customer than the total order. IMPORTANT: Sandals Shop not being able to automatically exclude orders with payment on delivery from Sardinia, smaller islands (Elba, Ischia, Capri, Anacapri, Pantelleria, Faviniana, Tremiti, Giglio etc.etc.) And Venice has the right to cancel the orders from these locations and propose to place a new order with payment by credit card and / or bank transfer.

4.3 Delivery costs for Europe have a minimum cost of € 9.90 and vary with the country of delivery. However, delivery costs are specified at the time the order is placed with the selection of the country of delivery and are considered blocked for supplies with a package weight of 0-2Kg.

4.4 No responsibility can be attributed to Sandali Shop in case of delay in the execution of the order or in the delivery of the order.

4.5 The delivery of the goods is always carried out on the ground floor and at the address of the recipient indicated in the order. The Customer must always insert a valid delivery address and a telephone number where a person in charge of collecting the goods is always present. The courier will always deliver during normal working hours, ie from 09:00 to 18:00. Sandals Shop categorically excludes the possibility of programming delivery times.

4.6 Upon receipt of the goods, the Customer is required to check the correspondence between the number of packages delivered with the number of packages shown on the transport document; it is also required to check if the packaging is intact, and if the product delivered to him complies with the order placed. If there are any discrepancies, the Customer will be required to sign the delivery note with the wording “WITH RESERVATION OF CONTROL OF THE INTEGRITY OF PRODUCTS”; if this does not happen, the Customer cannot contest, after delivery, the external non-conformity of the product ordered and its quantity.

5- Right of Withdrawal

Withdrawal from Italy and EU countries

5.1 The right of withdrawal for products purchased on the e-commerce site sandalishop.it is governed by articles 64 and following of the Legislative Decree 6 September 2005, n. 206 (Consumer Code). The decision to exercise the right of withdrawal must be made within 14 working days from receipt of the product ordered and must be carried out by the Customer by sending an email to: [email protected]

5.2 The notice of withdrawal must specify the intention to withdraw from the purchase (it is not necessary to specify the reasons instead) and the product or products for which it intends to exercise the right of withdrawal, attaching a copy of the documentation proving the purchase (number of order and order date, invoice number, item code of the products to be subject to withdrawal).

5.3 The right of withdrawal applies only to intact goods at the time of return, pursuant to the provisions of art. 67, paragraph 2 of the Consumer Code. Upon receipt of the package containing the returned product, and all checks on the integrity of the goods and on the presence of any tag, protective bag, gifts and everything originally contained in the product packaging itself, Sandali Shop will provide crediting of the amounts already collected for the sale of the product. By law, the shipping costs for returning the goods are charged to the customer.

5.4 Sandali Shop will refund the Customer for the amount of products already paid, net of shipping costs incurred and net of the recovery of any discounts benefited by exceeding the minimum purchase thresholds to which the discounts were linked. Example: if the customer has purchased 3 pairs of sandals for a total amount greater than € 100 (a necessary condition to benefit from the automatic discount of € 5) and wants to make 1 pair of sandals, the amount that Sandali Shop will go to repay will be equal to the price of the sandal made net of the discount of € 5. The same procedure will be adopted for any discount code used that is linked to specific minimums for purchases that have lapsed following the returned products.

5.5 The refundment as described above takes place within 14 days from the return of the goods, by transferring the amount charged to the credit card or by bank transfer. In the latter case, it will be the Customer’s responsibility to promptly provide the bank details on which to receive the refundment (ABI Code – CAB – Current Account of the invoice holder).

5.6 Sandals Shop, as specified in Legislative Decree 21/2014 (governing distance sales for customized goods) does not accept returns or exchanges for custom-made sandals upon customer request and for which a size has been requested, or a different color or fund compared to the sandals available for immediate delivery on the site and available to all users.

5.7 The right of withdrawal is lost for lack of the essential condition of integrity of the good (packaging and / or its content), in cases where Sandali Shop ascertains: • the lack of external packaging and / or original internal packaging. • the absence of integral elements of the product (tags, gifts connected to the returned product). • damage to the product for reasons other than transportation.

5.8 In the case of forfeiture of the right of withdrawal, Sandali Shop will return the purchased good to the sender, charging the shipping costs to the sender.

5.9 Sandals Shop excludes that the size guide on the website www.sandalishop.it may be object of dispute in the purchase choice, as it is reliable and tested on thousands of sales but whose accuracy depends on the accuracy of the subjective measurement carried out by the customer. For the reasons mentioned above, Sandali Shop cannot accept exceptions on the return policy listed in articles 5.1 to articles 5.8 of this sales contract.

Withdrawal from countries outside the European Union

5.2 Bis Send the package by post or courier according to your preferences. We recommend a standard shipping service with tracking as the sender will be responsible for any damage, non-delivery, delays. The return costs (shipping costs, any customs duties requested of us when the goods are returned to Italy) are charged to the customer.

5.3 Bis When completing the customs declaration forms (CN22 and / or CN23) it is necessary to indicate “Returned goods – Failed sale” and attach them to the outside of the package. Please carefully follow the return procedure indicated above as if customs / duties are found, the package will NOT be accepted and will be rejected (blocked at customs or returned with any additional costs always at the expense of the sender).

5.4 Bis Sandali Shop will refund the Customer the amount of products already paid, net of shipping costs incurred, net of any charges required by customs for the return of the goods in Italy and net of the recovery of any discounts received for exceeding of minimum purchase thresholds to which the discounts were linked. Example: if the customer has purchased 3 pairs of sandals for a total amount greater than € 100 (a necessary condition to benefit from the automatic discount of € 5) and wants to make 1 pair of sandals, the amount that Sandali Shop will go to repay will be equal to the price of the sandal made net of the discount of € 5. The same procedure will be adopted for any discount code used that is linked to specific minimums for purchases that have lapsed following the returned products.

5.6 Bis Sandals Shop, as specified in Legislative Decree 21/2014 (governing distance sales for customized goods) does not accept returns or exchanges for custom-made sandals upon customer request and for which a size has been requested, or a color or a fund different than the sandals available for immediate delivery on the site and available to all users.

5.7 Bis Sandals Shop excludes that the size guide on the website www.sandalishop.it may be object of dispute in the purchase choice, as it is reliable and tested on thousands of sales but whose accuracy depends on the accuracy of the measurement subjective made by the customer. For the reasons mentioned above, Sandali Shop cannot accept exceptions on the return policy listed in articles 5.1 Bis to articles 5.7 Bis of this sales contract.

6- Product Replacement

6.1 Sandali Shop recognizes the possibility of replacing the ordered product due to size, color, model only and exclusively for standard products “ready for delivery”, while this possibility is excluded for customized products.

6.1.1. Correct product reception

If the product received corresponds to the one actually ordered by the Customer, replacement of the product with a product showing the same sale price but with revised size or with revised color or with revised model is allowed. The customer will have to bear the costs of returning the product and returning it.

6.1.2. Wrong product reception
If there is no correspondence in size, color, or model between the product ordered and that received, the Sandali Shop will require one or more photos that document the discrepancy. The photos will be sent to: [email protected]

Having seen this eventuality, Sandali Shop will be activated immediately to replace the garment. Shipping costs only in this case will be considered at the seller’s expense.

6.2 Sandals Shop, as specified in Legislative Decree 21/2014 (governing distance sales for customized goods) does not accept exchanges for customized sandals at the request of the customer and for which a size has been requested, or a different color or background with respect to sandals ready for delivery on the site and available for all users.

6.3 Sandals Shop categorically excludes the possibility of replacing the ordered product with another product of a higher amount. To carry out this operation it will be necessary to proceed with activation of the withdrawal procedure (see point “Right of Withdrawal”) and instead place a new order for the desired product.

6.4 Sandals Shop excludes that the size guide on the website www.sandalishop.it may be object of dispute in the purchase choice, as it is reliable and tested on thousands of sales but whose accuracy depends on the accuracy of the subjective measurement carried out by the customer. For the reasons mentioned above, Sandali Shop cannot accept exceptions on the product replacement policy listed in articles 6.1 to articles 6.3 Bis of this sales contract.

7- Warranty

7.1 Sandali Shop declares that all the products present in the catalog and marketed comply with the technical standards required by law and good construction technique.

7.2 Sandals Shop is considered exempt from any damage caused by misuse of the products without having adopted the normal diligence on the part of the Customer.

8- Privacy

8.1 Sandali Shop guarantees its Customers compliance with the legislation on the processing of personal data, governed by Legislative Decree 196/2003 “Privacy Code”. The Customer can obtain all the information on how Sandali Shop treats his personal data by accessing the Privacy section.

9 – Applicable law and Disputes Solutions

9.1 The sales contract between the Customer and Sandali Shop is concluded in Italy and is governed by Italian law.

9.2 For all disputes relating to the validity, interpretation or execution of this contract, the Court of Brindisi will be exclusively competent.
